Overview of Prenuptial Agreements
Also known as premarital agreements and antenuptials, prenuptial agreements are legally binding contracts between future spouses that establish what assets and/or financial obligations belong to each party in the event of a divorce.  The primary reason for individuals to have a pre-nuptial agreement is so that both parties, rather than the courts, will define what will happen in the event of a divorce.  The prenuptial agreement typically details how property owned prior to the marriage will be divided if the marriage should end and how any jointly owned property will be addressed.  In addition, prenuptial agreements often address:

  • The rights and obligations of each of the parties regarding any and all property acquired before and after the marriage.
  • The disposition of property when a legal separation, divorce, or death occurs.
  • The ownership rights to and disposition of retirement benefits upon legal separation and divorce.
  • The ownership rights to and disposition of the death benefit from any life insurance policies either in place now or that will be taken out in the future.
  • The ownerships rights to and disposition of any inheritances, trusts, or wills that one or both parties may be entitled to or already have in the event of divorce or death. 

  • The body of law that will govern the construction of the agreement.

A pre-nuptial agreement can prove to be advantageous to both future spouses.  Because California is a community property state, having a pre-nuptial agreement in place before the marriage takes place can put limitations on what otherwise would be considered to be community property.  It is important to note that all pre-nuptial agreements must comply with the Uniform Premarital Agreement Act.
