About Divorce in Riverside County
As one of the first states to adopt the "no-fault" divorce concept, the most common ground for filing for divorce in California is irreconcilable differences. Other grounds for dissolution of marriage include among others, death or insanity.
Divorce proceedings can be contested in a Riverside court, or may be uncontested by a default judgment when one of the parties refuses to participate in the proceeding or can not to be located.
According to California Family Law, to qualify for dissolution of marriage in Riverside County, one of the spouses must have been a resident of California for a continuous six months and of the county for a continuous three months prior to filing a Petition for Divorce.

Once the Petition is filed and served on the other spouse, or "Respondent," the Respondent has 30 days to file a Response with the Court.
Once the Petition has been filed, the marital status cannot be terminated until six months from the date of filing, during which time both parties engage in the "discovery" process. This process involves the exchange of information and documents relevant to the case.
One of many requirements of discovery is the preparation and filing of the Preliminary Declaration of Disclosure, in which community and separate property, current income and declarations of expenses of each party is documented. In Riverside County, the employment of accountants, actuaries and appraisers is often necessary to assist in determining the value of marital property.
Also, it is common that an Order to Show Cause (OSC) hearing be requested for determining temporary child custody and child support orders, or restraining orders.
When child custody and visitation issues are in dispute, both parties must attend mandatory counseling prior to the OSC hearing. Mediation counseling is held at the Courthouse where your case was filed.
Upon completion of discovery, both parties and attorneys (if represented) will negotiate settlement of the case. If the case is resolved by agreement, a Martial Settlement Agreement, which contains all the terms of the agreement, will be prepared and signed by the spouses and attorneys.
In the event both parties are unable to fully agree on all issue of the case, a trial will have to take place.
