About Dissolution of Marriage in Riverside County
To qualify for a divorce in Riverside County, California, one of the spouses must have resided in California for a continuous 6 month and have resided in Riverside County for a continuous 3 months prior to filing the Petition for Divorce.
The most common ground for filing for dissolution of marriage in California is irreconcilable differences. Other grounds include death, insanity, or bigamy.
In California the general steps for filing a divorce are as follows.
- A petition to dissolve the marriage is filed by one spouse and served to the other spouse (known as the Respondent).
- Once the Petition is filed the Respondent has 30 days to file a Response with the Court.
- One spouse may file a request for an Order to Show Cause hearing to determine temporary child custody and child support terms, or invoke restraining orders.
- Both parties then engage in the "discovery" process. This process involves the exchange of information and documents relevant to the case, such as disclosure of income, expenses, and assets. Written questions and depositions may also be drawn up during this time.
- Both parties and attorneys (if represented) will then negotiate settlement of the terms of the case. If the case is resolved by agreement, a Martial Settlement Agreement, containing all the terms of the agreement, will be prepared and signed by the spouses and attorneys. If the parties cannot agree, a trial will take place.
- After signing the agreement, or after the trial has ended, a Judgment of Dissolution of Marriage will be prepared and filed with the court.
- The marital status cannot be terminated until six months from the date of filing
Divorce proceedings are contestable in a Riverside court when both spouses cannot agree on at least one issue involved. When both parties agree on all the terms of their divorce it is considered a "no-contest" divorce. If one spouse refuses to participate in the divorce proceeding or can not be located the divorce may be uncontested by a default judgment.
Mandatory mediation counseling must be attended by both spouses when child custody and visitation issues are in dispute. Mediation counseling occurs at the Courthouse where your case was filed.
