About Divorce in San Bernardino County


According to California law, one spouse must have been a resident of the state for a continuous 6 months and have resided in the county for a continuous 3 months prior to filing for divorce in San Bernardino County.

The state of California was one of the first states to initiate the "no-fault" divorce policy which accepts among others, irreconcilable differences, death or insanity as viable grounds for divorce.

Generally, the divorce process in San Bernardino County is as follows.

  • One spouse files a Petition for Divorce with the San Bernardino Court, which is then served personally to the other spouse, or "Respondent".
  • Upon being served the divorce petition, the Respondent has 30 days to file a Response with the Court.
  • In many cases there may be a request for an Order to Show Cause hearing, where a judge will rule on temporary child custody and child support terms, or restraining orders, which will remain in place throughout the dissolution process.
  • The process of "discovery" will then begin to unfold. Information and documents regarding income, expenses and assets of both parties are exchanged during this phase. Depositions and written questions may also be created at this time.
  • Negotiation for settlement of the divorce terms is engaged in by both spouses, along with their attorneys (if represented). If both parties agree on all the terms, a 'no-fault" divorce, a Marital Settlement Agreement outlining the specific terms of the divorce will be prepared and signed by both parties and the lawyers. In the event that the spouses are unable to agree upon every issue, the case will be considered a "contested" divorce and must be resolved court.
  • If the agreement was made and signed, or once the trial has ended, a Judgment of Dissolution of Marriage will be drawn up and filed with the court.
  • A couple's marital status cannot be terminated until six months from the date of filing.

If one spouse fails to participate in the divorce proceeding, or can not be contacted, the divorce can be considered uncontested by a default judgment.

When child custody and child visitation issues are in dispute, Mediation counseling, for both spouses, is a court mandated requirement that the parties must undergo before a court makes any rulings in custody or visitation.
